Action Required: New Agency and Agent Appointment Agreements Coming Soon

On May 14, 2024, Citizens announced changes to the Agency Agreement and Agent Appointment Agreement in the Agent Updates Bulletin.

Citizens requires all agencies and appointed agents to transition to the new Agency and Agent Agreements by June 10, 2025. To ensure this occurs, we will send a Notice of Intent to Terminate the old agreement effective June 10, 2025, incrementally to all. Agency principals (APs) and agents need to sign the new agreement no later than June 10, 2025, to maintain their relationship with Citizens.

Starting on April 3, 2025, and concluding on April 9, 2025, all agents and APs will receive the following emails:

You will be required to sign and return the documents within 60 days.

  • If the signed Agency Agreement is not completed by the AP within 60 days, the agency and all its appointed agents, licensed customer representatives, and support staff will be terminated on June 10, 2025.
  • If the signed Agent Appointment Agreement is not completed by each individual agent within 60 days, the agent will be terminated effective June 10, 2025.

Note: APs who are also registered as licensed agents will receive two separate DocuSigns.

Key Changes to the Agreements

The agent and agency agreements have been updated with the following changes:

  • Definitions
    • Modifies definitions and adds two new terms as a source for agent performance requirements
  • I. Agreement
    • B. Agency Performance or D. Agent Performance – streamlines Citizens’ ability to modify Agent Performance programs and clarifies enforceable actions for noncompliance
  • II General Requirements
    • C. Compliance with Citizens Requirements – clarifies compliance and performance standards
    • F. Citizens as the Residual Market Insurer – clarifies and strengthens language on requirements to re-market Citizens to the private market
    • M. Departure of Agent(s) from Agency or N. Affiliation with Agency – better clarifies rules on book of business transfers
  • III. Technology and Data Security Requirements
    • B. Access to Citizens systems – expressly prohibits credential sharing
  • IV. Operational Requirements
    • B. Premium Collection and Submission – requires segregation of premium from the Operating Account and prohibits assignment or transfer of any interest in Operating or Trust Accounts
  • V. Commissions
    • D. Authority to Withhold – clarifies Citizens' ability to withhold, offset, deny, or recover commissions
  • VI. Suspension and Termination
    • Clarifies and modifies reasons for Administrative Terminations and Terminations for Cause
  • VII. General Terms and Conditions
    • D. Florida Law, Jurisdiction, Venue and Service of Process and J. Challenges to Discipline – provides that disputes will be resolved at the Division of Administrative Hearings (DOAH)

The changes listed above are not all-encompassing, and these are just some of the key changes to the agreements.
